Download file to see previous pages The study aimed to determine how Australia can improve its legal framework to address the impacts of cybercrime on businesses. It also identified the weaknesses of cybercrime in Australia and gave suitable recommendations. The study was conducted through the analysis of secondary data. The result of the study indicated that the main cybercrime legislation in Australia is the Cybercrime Legislation Amendment Act 2012 which is an amendment version of the Cybercrime Act 2001. The Act accommodates the recommendation of the Council of Europe Convention on Cybercrime which the United States and most of the European countries ratified. Some of the main cyber activities that affect Australian businesses are cyber intrusion, remote access tools, water-hole techniques, malware, ransomware, distributed denial of service, and hacktivism. In recommendation, the law needs to be fully implemented and capacity building comprehensively conducted.

Cybercrime, also known as computer crime, is a type of crime that entails the use of a computer and its network. The computer might be the target of the crime or the tool used to commit the crime. Cybercrime can also be defined as offensive activities committed against someone or a group of people to harm him or them. The harm might be in the form of reputation, mental, or financial and can be conducted indirectly or directly. Cybercrimes are usually committed through the use of mobile phones and the internet thus entailing access to private groups, notice boards, emails, chat rooms, and even short messages to harm.

The crimes not only have financial effects but can also affect the security of a given country. Some of the high-profile cybercrimes are linked to child grooming, child pornography, copyright infringement, and hacking. Cybercrimes also affect the privacy of an entity through disclosing or intercepting confidential information either unlawfully or lawfully. In the global arena, both the government and non-state actors are involved in cybercrimes such as cross-border crimes, financial theft, and espionage. When cybercrime is done across international borders with the interest of a particular country, it is called cyber warfare.
